Terms of Use & Software License Agreement

These Terms of Use & Software License Agreement (“Terms”) govern your use of Dexxer software and related services provided by Dexxer LLC (“Dexxer,” “we,” “us,” or “our”).
By downloading, purchasing, installing, or using Dexxer, you agree to these Terms.
1. Dexxer Editions
Dexxer is currently available in multiple editions:
• Dexxer Free — direct download
• Dexxer Pro — paid direct download
• Dexxer – External Drive Search — Mac App Store edition
Certain features, licensing terms, purchasing methods, and update methods differ between editions.
2. Direct-Download License
Dexxer Free
Dexxer Free may be used without charge, subject to these Terms.
Dexxer Free currently allows use with one selected drive or folder. Features and limitations may change in future versions.
Dexxer Pro
A Dexxer Pro purchase grants one individual user a non-transferable license to use the direct-download Dexxer Pro software.
A Dexxer Pro license may be activated on up to three Macs personally used by the license holder.
The license key may not be shared with other users, sold, published, transferred, or distributed.
3. Dexxer Pro 1.x Updates
A Dexxer Pro license includes updates released within the Dexxer 1.x series.
Future major versions, such as Dexxer Pro 2.0, may be offered as separate paid upgrades.
Purchasing Dexxer Pro does not guarantee access to every future major version of Dexxer.
You may continue using the version you purchased even if you choose not to purchase a future major upgrade, subject to compatibility with your hardware and operating system.
4. Mac App Store Edition
Dexxer – External Drive Search purchased through the Mac App Store is a separate edition from the direct-download Dexxer Free and Dexxer Pro products.
The Mac App Store edition:
• Is purchased through Apple
• Does not require a Dexxer Pro license key
• Does not use Lemon Squeezy for activation
• Receives applicable updates through the Mac App Store
• Is subject to Apple’s applicable App Store terms and license agreement
Where Apple’s Standard End User License Agreement applies, that agreement governs the license for the Mac App Store edition.
5. Ownership
Dexxer software, source code, branding, logos, graphics, website content, and other Dexxer intellectual property are owned by Dexxer LLC or its applicable licensors and are protected by copyright and other intellectual-property laws.
Purchasing or downloading Dexxer gives you a license to use the software. It does not transfer ownership of Dexxer or its intellectual property to you.
Your files remain your files.
6. Restrictions
Except where applicable law expressly permits otherwise, you may not:
• Sell, sublicense, distribute, or transfer Dexxer software without authorization
• Share, sell, publish, or distribute a Dexxer Pro license key
• Attempt to bypass or circumvent Dexxer licensing or activation systems
• Reverse engineer, decompile, or disassemble Dexxer
• Modify Dexxer for redistribution
• Create or distribute unauthorized derivative versions of Dexxer
• Use Dexxer trademarks or branding in a way that falsely suggests affiliation with or endorsement by Dexxer LLC
7. Local Files and Saved Indexes
Dexxer is designed to create and search local saved indexes of user-selected drives and folders.
Dexxer does not take ownership of your files.
You are responsible for maintaining appropriate backups of your original files, drives, and important saved indexes.
Dexxer should not be treated as a replacement for a backup system.

8. Direct Purchases Through LemonSqueezy
Direct purchases of Dexxer Pro are processed through LemonSqueezy.
LemonSqueezy serves as the merchant of record for these transactions and handles payment processing and applicable transaction-related obligations.
Your purchase may also be subject to LemonSqueezy’s buyer terms and policies.
9. Refunds
Direct-Download Dexxer Pro
If you experience a problem with a direct Dexxer Pro purchase, contact Dexxer Support at support@dexxerapp.com with your order information.
Refund requests for direct purchases are reviewed based on the circumstances of the request and are also subject to the applicable policies and terms of our payment provider.
Mac App Store Edition
Purchases and refund requests for the Mac App Store edition are handled by Apple and are subject to Apple’s applicable App Store policies.
Dexxer LLC does not directly process Mac App Store payments or refunds.
10. Software Updates and Availability
Dexxer may release updates that add, remove, improve, modify, or replace features.
We do not guarantee that every feature will remain unchanged indefinitely.
Future operating-system changes, hardware changes, third-party services, or other circumstances outside Dexxer LLC’s control may affect compatibility with older Dexxer versions.
We may discontinue support for obsolete versions when reasonably necessary.
11. Third-Party Services
Dexxer may rely on third-party services for certain functions outside the core local indexing experience, including services used for:
• Direct purchase processing
• License activation
• Mac App Store distribution
• Website hosting
• Customer support
Those third-party services may be governed by their own terms and privacy policies.
12. User Responsibility
You are responsible for:
• Selecting the drives and folders you choose to scan
• Maintaining backups of important files and data
• Keeping your Dexxer Pro license key secure
• Using Dexxer in compliance with applicable laws
• Ensuring that you have permission to access or index the files and storage you choose to scan
Dexxer does not guarantee that a saved index reflects changes made to a source after its most recent scan.
If files have changed, moved, been renamed, added, or deleted, you should rescan the source to update its saved index.
13. Disclaimer of Warranties
To the fullest extent permitted by applicable law, Dexxer is provided “as is” and “as available,” without warranties of any kind, whether express or implied.
Dexxer LLC does not guarantee that the software will be error-free, uninterrupted, compatible with every device or storage format, or that search results will always be complete or accurate.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable law.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Dexxer LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use Dexxer.
This includes, without limitation, damages arising from:
• Loss of data
• Loss of files
• Drive failure or corruption
• Lost profits or business interruption
• Incorrect or incomplete search results
• Loss of saved indexes
You are responsible for maintaining appropriate backups of important data.
Where liability cannot legally be excluded, Dexxer LLC’s liability will be limited to the maximum extent permitted by applicable law.
15. Termination
Your right to use Dexxer may terminate if you materially violate these Terms, including unauthorized distribution of the software or misuse of a Dexxer Pro license key.
Upon termination, you must stop using any Dexxer software for which your license has been terminated.
Provisions concerning ownership, restrictions, disclaimers, limitation of liability, and other terms that reasonably survive termination will remain in effect.
16. Changes to These Terms
We may update these Terms as Dexxer, our distribution methods, or applicable requirements change.
When material changes are made, the “Last Updated” date at the top of this page will be revised.
Continued use of Dexxer after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
17. Governing Law
These Terms are governed by the laws of the State of Tennessee and applicable United States federal law, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
